The Superior Council of Magistracy approves Felix Banila as chief prosecutor of anti-mafia unit

The prosecutor’s section of the Superior Council of Magistracy (SCM) on Tuesday approved the proposal of the Ministry of Justice to appoint Felix Banila as chief prosecutor of Romania’s Organised Crime and Terrorism Investigation Directorate (DIICOT), the SCM informs.

“On Tuesday, the Prosecutors Section of the Superior Council of Magistracy approved the proposal of the Minister of Justice for appointment as Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorism by Mr. Banila Oliver-Felix, prosecutor at the Prosecutor’s Office near the Bacau Tribunal,” according to a press release of the CSM.

The quoted source states that the decision of the Section will be motivated and forwarded to the Ministry of Justice during Wednesday.

Felix Banila on Tuesday interviewed CSM for the post of chief prosecutor of the Directorate for the Investigation of Organized Crime and Terrorism. On May 14th, Justice Minister Tudorel Toader sent the SCM a proposal to appoint Felix Banila as Chief Prosecutor of the Directorate for the Investigation of Organized Crime and Terrorism.

Only two candidates – Daniel Horodniceanu, the current chief prosecutor of the institution, and Felix Banila, prosecutor at the Prosecutor’s Office attached to the Bacau Tribunal – were registered with DIICOT.

According to the legal regulations in force, the chief prosecutor of DIICOT is appointed by the President of Romania, at the proposal of the Minister of Justice, with the opinion of the SCM. Appointment is for a period of three years, with the possibility of re-inviting only once.

Before Daniel Horodniceanu was named the head of DIICOT the anti-mafia unit was Alina Bica, that was prosecuted for abuse in office and bribery in a case involving illegal restitution for businessman Stelian Gheorghe by the National Authority for Property Restitution (ANRP). She is still on trial together with the businessman Dorin Cocos and his son Alin Cocos but she is now in Costa Rica where she claims that she has a protected status as a refugee.
