The Romanian High Court of Justice (ICCJ) approved the appeal by which Electrolux Romania S.A. requested the suspension of the decision of the Competition Council, which had issued a fine of RON 9.8 million for the company.
The appeal solution supports the pronounced decision in first instance in the main file. Therefore, on November 13, 2015, the Court of Appeal from Bucharest decided the exemption of the decision and annulment of Electrolux Romania from the fine payment.
Even if the decision is not definitive, being the subject of the ICJ control, the solution from the first instance contributed to the arguments consolidation of inequality examined by ICCJ.
“The appeal solution is important because, despite the unfavorable trend of legal practice, it validates the arguments of Electrolux Romania regarding the inequality of the administrative act,” said Anca Buta Musat, partner at law firm Musat & Asociatii.
