Romanian Health Ministry updated the clawback tax

The Health Ministry has changed the clawback tax to make it functional. The new provisions mentioned in a bill will apply as of October 1. The changes were designed by the Romanian Health Ministry in partnership with the Public Finance Ministry.  

“I want to underline the fact that the clawback mechanism is not a new tax. Even to this moment, this tax was mandatory for medicament companies, which had to contribute udner a tax applied to the sales volumes for all medicaments. The system proved to be dysfunctional, as only 5 percent of the forecasted sum was collected”, explained Ritli Ladislau, the Romanian Health minister.

According to the new bill adopted by the Government, medicament companies in the Romania or their legal representatives will have to pay every trimester a mandatory contribution, by applying a certain percent on the value of medicaments consumption, supported from the national social insurance fund, as well as for medicaments distributed in pharmacies and health centers. The payment will be made depending on the market share of each company. The Health minister mentioned that patients will not have to pay additional sums for medicaments.                     

The national health insurance body (CNAS) will calculate the percentage that each company in the regulated market will have to pay.  
For instance, if the state allocates a RON 100 million budget for medicaments in a trimester, but the real consumption reaches RON 150 million, the company will have to pay 33 percent of the sales volume to the state.
