Flightclaim.ro files 25 lawsuits against airline companies in Romania

On the background of increasing air traffic from both Bucharest and other large airports in the country, as well as the increase in low cost frequencies, the demand for FlightClaim.ro’s services to obtain compensation for airline passengers increased by more than 450 percent in 2018 compared to 2017.

The number of lawsuits filed with airlines who are delaying payments for the amounts they owe to passengers has also increased proportionally. FlightClaim.ro’s legal team has opened in the last two months over 25 lawsuits against airline companies present in Romania, for compensations not paid to Romanian passengers, at no cost for affected passengers.

In total, a total of 67 cases are currently open against 14 air carriers. The solution of notifying courts is only addressed when the airline refuses or delays paying passengers, and passengers are 100 percent entitled to compensation for delays or cancellations.

FlightClaim.ro, together with the team of lawyers with whom it works, formulates the petition to sue and follows all the steps to complete the judicial process, which can take up to 4 months in the first instance, in order to obtain an enforceable decision. All the cases completed so far have had positive results and passengers have received compensation of up to EUR 600 per person, the airline being the one that also supports FlightClaim.ro’s court costs.

What are the situations where airline companies refuse or delay payment of compensation?

The main excuse invoked by airlines is the presence of extraordinary circumstances that would have caused flights to be delayed or cancelled. These include political instability, weather conditions, passenger safety risks or strikes affecting air carrier operations. Judicial practice has shown that these are just reasons to discourage passengers from claiming their rights, which is why FlightClaim.ro collaborates with a team of lawyers from Romania and other European countries to take over all cases of refusal or delay in payment by airlines.

Some airlines pay only on the basis of a court order, with the recognition of claims before the first trial (to avoid adding court costs).

Some airlines call for the passenger not to board, especially for those with check-in and hand baggage who do not show at the check-in desk to register at the airport after they learn that the flight is canceled or delayed very much.

”Most of the problems arise from passengers being poorly informed about their rights. It’s complicated for an individual to sue and fight in court against the big airlines and that’s why at FlightClaim.ro we offer free judicial representation service for situations where the airline does not recognize the passenger’s compensation and delay the settlement the request made by FlightClaim.ro on its behalf. Most of the time, no court decision is reached, the airline accepting to pay to avoid adding costs,” said Cees Werff, general manager of the Dutch firm Claims Corporation Network, which owns the FlightClaim brand throughout Europe, including FlightClaim.ro that assists passengers in Romania.

Depending on the length of the delay, passengers are eligible for compensation between EUR 250 and EUR 600 per person, plus other expenses. Less than 10 percent of passengers affected by flights canceled, delayed or refused boarding claim compensation from airlines or specialized firms.

This extremely small percentage is due to the poor knowledge of passengers’ rights, the difficulty of getting in direct contact with the airline, or simply the lack of time. The FlightClaim.ro process of getting compensation is very simple: the passenger does not pay anything, sends the flight details to the company, which empowers it to get the compensation, and deal with the whole process with the airline.
