Telecom providers should no longer store the personal data of their customers, after the Big Brother Law was deemed invalid.
The decision of the Romanian Constitutional Court was published in the Official Gazette, after the court ruled in July that Law 82/2012, also known as the Big Brother law, is unconstitutional.
The Big Brother Law made it compulsory for providers of mobile and fixed telephony and internet services to retain for six months certain data of their customers, which they were compelled to send to the authorities for the prevention and discovery of severe crimes.
The Big Brother law was ruled invalid at European level by the European Court of Justice, which on April 8 established that Directive 2006/24/CE was no longer valid, as it represented a serious interference in the fundamental rights to private life and personal data protection.
