President Iohannis to notify Constitutional Court on the amendment of Criminal Codes

.Romanian President Klaus Iohannis announced it will notify the Constitutional Court of Romania (CCR) in regards to the amending of the Criminal Codes.

“In the matter of the GEO I decided to notify the CCR,” the Romanian president said. According to the president, the notification relates to the legal conflict between the Government on the one hand, and the justice system and the Parliament, on the other hand.

President Iohannis stated that the notification has already been sent to the CCR. According to the Presidential Administration, in the request sent to the CCR shows that, through adopting the GEO to amend the Criminal Codes, “the Government exercised its power to adopt acts in breach of the laws on the constitutional legislative delegation.”

“On 31 January, the Government adopted the Emergency ordinance no. 13/2017 for amending and supplementing Law no. 286/2009 on the Criminal Code and the Law no. 135/2010 on the Criminal Procedure Code (published by the Official Gazette no.92 on 1 February 2017). We ask the Constitutional Court to acknowledge the existence of a legal conflict of a constitutional nature between the Government, on the one hand and Parliament and the Superior Council of Magistracy, on the other hand, conflict born following the Government decision,” the request said. Through the adoption of this emergency ordinance the Government exercised its prerogative to adopt legal acts breaching the constitutional framework on delegating.

Take your hands off the DNA!

“Take your hands off the National Anticorruption Directorate (DNA),” Iohannis said on Thursday. He reacted to information disseminated in the public sphere that the DNA and the Directorate for Investigating Organised Crime and Terrorism (DIICOT) could be reorganised. The two bodies could merge and could be headed by one individual.

Iohannis demands written explanations on gendarmerie role at protests

“I request Ms. Minister of Internal Affairs and the Gendarmerie for urgent and clear written explanations on why and how it was possible to allow violent elements to destroy a peaceful rally with all the Ministry of Internal Affairs on site,” Iohannis said at the Cotroceni Palace.
