Declaration 112 up for public debate. What does it include?

The Ministry of Public Finance, together with the Ministry of Work and Social Justice and the Ministry of Health, have initiated a draft joint order setting out the model, content and manner of submission and management of Declaration 112 as a result of legislative changes in the field of social contributions owed by persons physical and legal, according to a press release from the MFP.

The Statement on Payment of Social Contributions, Income Taxes and Insured Persons, known as Declaration 112 (D112) includes both information on taxpayers’ tax obligations and information required for the determination of social benefits under the specific legislation granted by the National House of Public Pensions The National Health Insurance House and the National Agency for Employment (ANOFM).

The draft order establishes that withholding tax on income tax and compulsory social contributions, as the case may be, for income taxpayers: from intellectual property rights, made on the basis of sports contracts concluded on the basis of lease agreements; from associations with taxpayers according to Titles II and III or Law no. 170/2016.

Also, there are included special provisions regarding the way of calculation, declaration and payment of social health benefits for individuals who make incomes exempt from the payment of income tax included in article 60 of the Fiscal Code; special provisions on the option of distributing and paying monthly amounts for the grant of private scholarships as well as for supporting a non-profit entity / cult units accounting for 2 percent or 3.5 percent of the tax by the payer of income; the corresponding updating of the annexes to the order according to the changes to the specific legislation.
